USADA moves Armstrong case to arbitration panel

(AP) ? The U.S. Anti-Doping Agency says its review board has made a unanimous recommendation to file formal doping charges against Lance Armstrong.

That will move the case to an arbitration hearing if Armstrong chooses to challenge, as he has indicated he would.

USADA confirmed the board's recommendation Friday after one of its members, Clark Griffith, told The Associated Press he "can't wait" to see what the arbitration panel thinks of the evidence.

USADA says it has evidence Armstrong was taking performance-enhancing drugs while winning the Tour de France from 1999-2005. Armstrong says he is innocent.

Hoax prompts free tacos in Alaska town

ANCHORAGE, Alaska (AP) ? Residents of Bethel, Alaska, know from cable TV ads what the major fast-food chains offer: chicken at KFC, burgers at McDonald's and tacos at Taco Bell.

They just haven't been able to get any of it.

The city of 6,200 people is about 40 miles inland from the Bering Sea in far western Alaska, and the closest fast food other than a Subway sandwich shop is in Anchorage, 400 miles and a $500 round-trip plane ticket away.

So they were elated to learn that Taco Bell was soon going to open a restaurant.

The joy, however, turned into disappointment. The flyers announcing the chain's arrival were a hoax ? the result, police say, of a feud between two residents.

But all was not lost.

Taco Bell executives learned of the mix-up and arranged an enormous feast for Sunday. They plan to fly enough ingredients in from Anchorage to make 10,000 tacos.

"It'll be a big event for our community," Mayor Joe Klejka said.

Taco Bell will offer its fare for free. There will be 950 pounds of seasoned beef, 300 pounds of lettuce, 150 pounds of cheddar cheese, 500 pounds of reduced fat sour cream and 300 pounds of tomatoes.

The chain is accustomed to feeding large groups of people in far-flung places.

"If we can feed people in Afghanistan and Iraq, we can feed people in Bethel," company CEO Greg Creed said, declining to discuss the cost of the feast.

The community-wide event comes at the right time.

Since it is the start of the Fourth of July holiday, the population is expected to rise, up to 10,000, as people from outlying villages arrive for the week.

Police Sgt. Chris Salyers said the hoax appeared to be the result of one resident retaliating against another.

Flyers went up in June, announcing the opening and including a phone number to call to inquire about a job at the new restaurant. The number belonged to the targeted person.

Bethel has a large transient population, with people moving from the Lower 48 to work in the hub city. The city has no bars, and will soon have its first movie theater, said Angela Denning-Barnes, news director at radio station KYUK.

There are a dozen or so restaurants, most with similar menus. A couple of restaurants offer some Mexican food, but the price is prohibitive ? $15 for a burrito and rice.

The Subway is quite popular, but getting a taco means flying to Anchorage.

"It's kind of an expensive taco," said Sam Blankenship, who works for the city.

Galaxy Nexus banned in the U.S. following preliminary injunction in Apple patent case

You read that right, sales of the Samsung Galaxy Nexus in the U.S. have been temporarily banned after the court granted Apple?s request for a preliminary injunction against the Galaxy Nexus in their ongoing patent lawsuit.

As soon as Apple posts a bond of approximately $96 million (the estimated costs for Samsung should the court decide this injunction was wrongly applied) the ban will go into effect. Samsung can of course appeal this ruling and that could happen as early as next week, which could potentially bring this to a very abrupt end. If Samsung is unable to convince the court to reverse this decision the ban will remain in effect until the trial is concluded.

There are four total patents at issue in this case. The first is the same one that proved problematic for HTC that allows the device to identify text or numbers to pull up a relevant menu or action. The second is basically word prediction for a touchscreen keyboard. The third is the ever popular slide-to-unlock patent and rounding out the quartet is a patent for a single search interface that allows the device to search a variety of sources both on and off the device.

Now those are very simplistic descriptions of these patents, but I am nevertheless baffled as always that not only were these patents granted in the first place, but that a judge finds them to be compelling. And to be clear this does not bode well for Samsung in the trial as the standards for granting a preliminary injunction are fairly high, requiring that the judge believed that the patents were likely valid and that Samsung had indeed infringed upon them and is causing Apple irreparable harm by having the Galaxy Nexus on sale.

There has been no official comment from Samsung as of this posting, but we?ll keep you updated as any new information becomes available.

German lawmakers OK fiscal pact, euro fund

BERLIN (AP) ? German lawmakers on Friday approved Europe's new budget-discipline pact as well as the eurozone's permanent ?500 billion ($623 billion) rescue fund, hours after Chancellor Angela Merkel defended concessions she made to financially troubled European nations at a summit.

A solid majority of more than two-thirds of all lawmakers of Parliament's lower house endorsed the two sets of legislations in a late night session, following urgent calls by Merkel to back the projects deemed crucial to stabilizing the 17-nation currency zone.

Merkel said supporting the fiscal pact and rescue fund sent "a signal of unity and determination, domestically and abroad; a signal toward overcoming the European government debt crisis sustainably, and a signal that for us Europe means our future."

"With these agreements, we are taking irreversible steps toward a sustainable stability union," she said.

The plans had support from Germany's two main opposition parties. A two-thirds majority was needed for the fiscal pact because it involves an internationally binding commitment to keep Germany's deficit low.

Parliament's upper house, which represents Germany's 16 states, is expected to approve both plans later in the evening, but its approval doesn't mean that the legislation will take effect immediately.

Germany's Federal Constitutional Court has asked President Joachim Gauck not to sign it into law immediately after Friday's parliamentary votes so that it has time to decide on expected calls for injunctions blocking the legislation. A decision could take as much as a few weeks.

Lawmakers voted 491-111 Friday with six abstentions to back the discipline pact ? the so-called fiscal compact to which 25 of the European Union's 27 members have signed up.

Lawmakers also voted 493-106 in favor of the rescue fund, the European Stability Mechanism, with five abstentions.

The fund is meant to be operational next month, which required lawmakers to pass the legislation at the latest on Friday. Germany must pay about ?22 billion in capital to underwrite the fund, and it guarantees about a third of its lending capacity.

Merkel noted that, in the future, countries will have to implement the fiscal pact to be eligible for aid from the ESM. "There is a legal link between solidity and solidarity, and I consider that very important," she said.

In her speech a few hours after returning from the summit in Brussels, Merkel defended concessions she had made there. She assured lawmakers that help to struggling countries and banks will still come with strings attached and insisted that some decisions were misunderstood.

Merkel had been opposed, at least in the near term, to some of the measures that she and the other 16 leaders of the euro countries agreed upon Friday. They include allowing Europe's bailout fund in the future to give money directly to a country's banks, without imposing strict austerity conditions on the government.

German media headlines immediately after the summit portrayed the outcome as a political defeat, but Merkel said her tough-love approach was intact.

Merkel told Parliament it was a "sensible decision" to allow countries that pledge to implement reforms demanded by the EU's executive Commission to tap rescue funds without having to go through the kind of tough austerity measures demanded of Greece, Portugal and Ireland. It was a concession to Italy and Spain in particular.

Merkel insisted it was only about helping countries whose financial stability is threatened by high interest rates but don't need to be taken off markets altogether.

She said there will always be conditions and a time frame, which will be supervised, and told lawmakers they should read the EU Commission's current economic policy recommendations for Italy and Spain ? "they are tough conditions."

Heading in to the Thursday-Friday summit in Brussels, Merkel had appeared thoroughly uncompromising ? insisting on the importance of getting budgets in order and improving eurozone strugglers' competitiveness while brushing aside talk of shared debt liability in Europe.

But in a victory for Spain and Italy, she agreed that funds set up to bail out indebted governments could be allowed to funnel money directly to stressed banks, once an "effective single supervisory mechanism" for banks is set up.

Merkel said that it was a matter of "several months or perhaps a year" but that having an effective supervisor that could set and enforce conditions "changes the conditions for the question of how we can deal with banks in the eurozone."

I first wrote about Belgian painter, illustrator and photographer Ben Heine back in 2010, when I highlighted his delightful series called ?Pencil vs. Camera?, in which he draws a continuation or substitution for part of a scene, usually in pencil on a ragged edged piece of paper or card, and then photographs the drawing held up against the original scene (images above, bottom four).

I?m delighted to say that among his other projects, Heine is continuing Pencil vs. Camera , and you can view the series either on his website or on his deviantART page.

One of Heine?s more recent projects is a series of images he calls ?Digital Circlism?. For these he creates portraits with digital tools in which the image is formed from a series of discreet circles of flat color against black backgrounds, in a process he describes as a cross between pop art and pointillism.

As with his other projects, you can view the galleries on either his website or deviantART. (I found the deviantArt pages easier to browse than the website.)

Heine also maintains a blog in which he discusses his work and features new images and in progress works.

TRMM Satellite measures Debby's drenching Florida rains

NASA's TRMM satellite provided data that allowed scientists to calculate Tropical Storm Debby's rainfall totals across Florida. The highest rainfall totals from June 20-27 topped 380 mm (~15 inches) in a wide patch of central Florida from around Titusville on the east coast.

Even though it never became more than a tropical storm, the residents of northern and central Florida will remember Debby. Debby, which formed as a tropical storm on the 23rd of June 2012 in the central Gulf of Mexico, took three full days to reach the Big Bend of Florida just 350 miles away. Although the center didn't make landfall until around 5 p.m. EDT on the afternoon of June 26 when it crossed the coast near Steinhatchee, Florida, Debby's effects were felt well away from the center.

Most of the rain and weather associated with Debby were well to the north and east of the center over Florida, which was effectively inundated with rain squalls originating over the Gulf and wrapping around the eastern side of the storm for 3 days. The result was copious amounts of rain over the central and northern parts of the state in addition to an outbreak of tornadoes over central and southern Florida on June 24.

In addition to capturing detailed images of tropical storms, TRMM is ideally suited to measure rainfall from space. TRMM is a joint mission between NASA and the Japanese space agency JAXA.

For increased coverage, TRMM is used to calibrate rainfall estimates from other additional satellites. The TRMM-based, near-real time Multi-satellite Precipitation Analysis (TMPA) at the NASA Goddard Space Flight Center in Greenbelt, Md. is used to estimate rainfall over a wide portion of the globe. TMPA rainfall totals are shown here for the 7-day period June 20 to 27, 2012 over and around Florida.

TRMM data showed that the highest rainfall totals for the period are in excess of 380 mm (~15 inches). The heaviest rains cover a wide patch of central Florida from around Titusville on the east coast to around Homosassa Springs on the west coast within which amounts exceed 260 mm (~10 inches) to over 380 mm (~15 inches) in the center. Another band of heavy rain is oriented east-west across northern Florida from Jacksonville to near Tallahassee with similar amounts or rain.The highest totals in the band occur around Lake City and exceed 380 mm (~15 inches). This east-west band can be attributed to the interaction of Debby's counterclockwise circulation with the coast and a frontal boundary draped across southern Georgia in an east-west orientation.

After coming ashore, Debby was downgraded to a tropical depression as it crossed northern Florida.

At 5 p.m. EDT on June 27, Debby lost tropical characteristics and became a post-tropical cyclone over the Atlantic Ocean. At that time Debby had maximum sustained winds of 40 mph (65 kmh) and it was located about180 miles (295 km) east of St. Augustine, Fla., near 29.5 North and 78.3 West.

On Thursday, June 28, 2012 at 8 a.m. EDT, the National Hurricane Center noted that showers and thunderstorms associated with post-tropical storm Debby were about 175 miles west-northwest of Bermuda. The shower and thunderstorm activity increased today and the winds are between 15 and 20 mph.Post-tropical Storm Debby continues to move to the northeast and the National Hurricane Center noted that it has a 10 percent chance of re-generating.

Why Did Microsoft Really Unveil Surface Tablets?

Speculation, once again, is all wrong. Following Apple's model, Microsoft created Surface tablets to lure people into Microsoft stores.

I was startled by a Fox News headline that read, "Microsoft will quit making tablets soon, Acer founder says." The article goes on to speculate on Microsoft's intentions for its new Surface tablets.

According to the article, Microsoft "more or less kept its partners in the dark, with some discovering the breaking news along with everyone else at Monday's event." None of Microsoft's partners have any idea what the long term intentions of the company are. Many claim that Microsoft will relent from the hardware game because of channel conflict. It would just hate to step on the toes of its OEMs.

This is baloney.

First of all, nobody is coming to bat with a Windows 8 tablet and Microsoft knows it. The iPad rules the scene and no one else will do much more than fool around with variations on a theme, mostly using Android. The closest anyone has come, it seems, is Samsung with its Galaxy Note, which isn't really a tablet, but a huge phone.

The space is moribund and so Microsoft jumped in. Does anyone seriously think that if Surface sales skyrocketed and brought in billions of dollars that Microsoft would give the product to Acer or Dell? "Here you make all the money, we have enough!"

Overlooked in all the analysis is the fact that Microsoft needs branded products to sell at the Microsoft stores. It's amazing how many people have yet to grasp the reality that Microsoft is opening storefronts left and right. Today's count indicates that there are 20 stores now open for business with five more coming soon.

These stores will fail if they devolve into a second coming of CompUSA. They need to be like Apple stores and that means they must sell branded merchandise. There are no margins in reselling HP or Dell computers, and HP has already threatened to quit the PC business once already.

While Dell's business does include a lot of sales to individuals, it is not its focus. It's part of its service strategy.

Microsoft sees the writing on the wall and it is more than competent enough to make and sell hardware. It made a point of talking about its hardware business at the press conference. It made the CP/M card for the Apple II in 1980. It made an EGA board shortly thereafter. It made a mouse, keyboards, and toys. The Xbox and the accessories were the final touch. It is a computer, after all.

So why would this shock anyone. Nobody is clamoring to build Windows RT tablets, are they?

The Apple stores, if you haven't noticed, account for the incredible success of the company over the past few years. They bring in a whopping $4,000 per square foot in annual retail sales, topping perennial sales star Tiffany & Co. The 363 stores in 13 countries move products like crazy?and Microsoft has noticed. It needs stores and branded products, period.

Will Microsoft end up competing with its customers? Not if it only builds high-end, high-margin products designed to sell at retail by a sales force. Today's PC market is a commodity market filled with low-ballers trying to sell the cheapest things they can. These folks are always on the verge of dropping Windows. Microsoft knows this, too. It's been playing a defensive marketing game for years.

Microsoft has gone too far with this Surface tablet merely to lure others into licensing some reference design that will be too costly to manufacture and then low-ball. No, this is a machine designed to be a show piece at the stores. Expect to see more products like this from the company over the next few years.

Stockton, California, to file for bankruptcy

STOCKTON, California (Reuters) - Stockton, California, is expected to file for bankruptcy before the end of the week, becoming the largest U.S. city to seek protection from its creditors.

No one in the city of nearly 300,000 is relishing the prospect, though some see no choice.

Stockton, which boomed a decade ago with workers from the San Francisco Bay area seeking affordable housing, is the most recent casualty of the housing bust of the past few years.

After failing to strike a deal with city employee unions and other creditors, Stockton's city council passed a budget after a five-hour meeting on Tuesday night. The budget calls for an end to retiree healthcare benefits a year after the city files for bankruptcy, which is expected by Friday afternoon.

Stockton busted spectacularly, and it still is swimming in foreclosures. It has been cutting city jobs for years. The cost of pensions and healthcare have overwhelmed it.

The plan for Chapter 9 bankruptcy, which includes dropping healthcare for retirees who are now fully covered, will close a $26 million deficit in Stockton's budget for its fiscal year that begins on July 1.

Former city workers, often too young to retire under stricter federal guidelines, face poor employment prospects.

Since October 2007, the last time unemployment was under 10 percent in Stockton, the city's population of job seekers has swelled by 10,000 and the number of people who are employed has decreased. Unemployment was estimated at 17.5 percent in May.

"I'm pretty much out of luck," said Patricia Hernandez, 57, who retired two years ago from her job with the city library. A cancer survivor, she is worried the disease might return.

Her diabetic husband gets dialysis worth $22,000 a month, which she does not expect to be able to afford after Stockton cuts medical coverage in a year.

Hernandez retired young, but not in luxury, and takes in about $1,700 per month. She is five years too young for early retirement in the federal Social Security program.

Stockton, like many California city and state governments, lets employees retire as early as 50 or 55. While some public pensions in the state are more than $100,000 per year, the statewide monthly average for the California Public Employees' Retirement System (Calpers), which administers Stockton's plan, is $2,332. The average Calpers retirement age is 60.

CITY NEVER SET ASIDE FUNDS FOR HEALTHCARE

Stockton never set aside funds for retirees' healthcare, so it has had no cushion as their medical costs soared. During the 1990s the city greatly expanded its generous healthcare benefits to retirees. Stockton officials say the city faces today a liability for its retiree medical program of $417 million.

Former Stockton City Manager Dwane Milnes, 66, who represented retirees in talks with the city, estimates that a majority of retired Stockton employees will not be able to pay for healthcare.

Geri Ridge, a single 56-year-old former records assistant for Stockton's police department, has told her daughter to sign up for MediCal, the state's health plan for the indigent. Ridge had counted on having healthcare coverage when she calculated that she could retire early on a pension, which is $1,895 per month.

"I expected the city to take care of me," said Ridge, who left the city's payrolls after a heart attack and will now drop her coverage.

While Stockton will cut retiree healthcare coverage, it does not plan to alter pension plans for fear of a battle with Calpers. Some taxpayers consider benefits for city employees a sweet deal.

"I was amazed by the level of benefits we received," said former city planner Denise Jefferson. "It was ridiculous."

She now works for a business improvement district and sees bankruptcy as being necessary for Stockton. "I'm thinking 'Welcome to the real world,'" she said.

"For people who say, 'You can't do this,' I say show us the pot of money," she said. "There's no money."

Standard & Poor's Ratings Services downgraded Stockton to default from selective default on Wednesday, citing the city's move toward bankruptcy and expectations that it will not substantially pay all of its obligations as they come due.

Moody's Investors Service on Wednesday cut to 'Caa3' various general fund-supported debts of the city, putting the ratings in the "substantial risk" category, one notch above the "may be in default, extremely speculative" grouping.

Moody's said its move was based on Stockton's bankruptcy budget. It suspends $10.2 million in debt payments along with cutting employee compensation and retiree benefits by $11.2 million. About $7 million in savings would come from cutting retiree medical benefits for one year and then phasing them out.

Stockton has already defaulted on about $2 million in debt since February, allowing the trustee for one of its bond insurers to seize a building once slated to be its future city hall and three parking garages.

Social Media: A Powerful Weapon for Paralegals in Police ...

Social media has become a goldmine for investigations and discovery in civil litigation. To be sure, the popularity of social media has exploded in recent years. As of 2011, Facebook boasts more than 750 million active users, at least 50 percent of whom log on to Facebook on any given day. Twitter has more than 200 million registered users, with 460,000 new users joining every day, and an average of one billion tweets per week, according to The Huffington Post. LinkedIn claims it had more 100 million users and in excess of 2 million businesses with company pages. With increasing frequency, courts are finding that what a person posts on Facebook can be admitted in litigation.

DONT FRIEND THE OPPOSING PARTY

A paralegal or legal assistant may be asked to conduct research on Google, other search engines, or social networking sites for an opposing party, witness, or expert. The supervising attorney may have a legal assistant or paralegal save screen shots of someones Facebook account, then submit an affidavit or otherwise testify about the method in which the information was procured and produced.

Caution should be used, however, when trying to friend an opposing party or witness for litigation purposes. An article appearing in the January/February 2012 issue of Federal Lawyer Magazine, Christopher E. Parker, Travis B. Swearingen, Tweet Me Your Status: Social Media in Discovery and at Trial, 59-FEB Fed. Law. 34 (2012), the authors suggest that paralegals should not friend an opposing party or a witness to obtain information about a person on a social networking site. Courts and ethics opinions have concluded that conduct like this may violate ethical rules (see Philadelphia Bar Opinion 2009-2).

Rather than furtively gain access to a users account through a friend request, legal counsel can pursue information found on social media through traditional discovery, such as interrogatories and requests for production of documents. A paralegal may assist the attorney in drafting discovery requests or responding to discovery requests for information posted on a social networking site.

Besides the use of social media sites for investigations in civil litigation and employment screening, police and law enforcement officials are increasingly using social networking sites to gather information as part of investigations. Content posted on social media sites can serve as direct evidence of a particular crime. In addition, evidence can be used to illustrate the character and lifestyle of an accused person. For example, in 2005, photographs taken at a post-game riot after a Pennsylvania State University football game were posted on Facebook, which police then used to identify and cite about 50 students. Photographs of gang symbols, weapons, or tattoos posted on social networking sites can also be used to identify and gather information of suspects.

As powerful as social media can be as an investigation weapon, it can also be vulnerable to nefarious attack. In June 2012, for example, LinkedIn user data were jeopardized when its database was hacked and at least 6.5 million passwords were stolen and posted on a Russian hacker site. Many people will often use the same password for several sites, which opens up the possibility for hackers to gain unauthorized access to other websites.

In coming years, as social media becomes more widespread, using content and data posted on social networking sites for investigations will continue to increase. And as that need increases, rest assured that paralegals and others in the legal profession will have to have finely-tuned social media skills.

George Hobica: Ask Airfarewatchdog: Update On 'Rule 240'

Q: What is the Department of Transportation policy governing airline delays due to mechanical failure? We were stuck at the New Orleans airport for more than 10 hours when our plane had an engine problem and would like compensation.

A: There is no D.O.T. rule concerning compensation when an airline experiences a mechanical problem. There used to be a D.O.T. rule called Rule 240 that required airlines to put you on another airline's flight in such circumstances, if that airline would get you to your destination sooner than your original airline. (But see the next question.) Airlines often will provide some compensation, usually in the form of a travel voucher or frequent flyer miles, in such cases. It doesn't hurt to ask.

Q: Does any airline still have a Rule 240?

A: Rule 240 was a clause in airline contracts of carriage back when airlines were regulated by a government agency. It stated that, except in cases of "force majeure" (i.e., an act of God such as severe weather), airlines had to offer you any available seat on a competitor's next flight out in the event that your original flight was canceled or severely delayed. Airlines formed after deregulation, such as Virgin America and JetBlue, never had a Rule 240, but most "legacy" carriers (American, Delta, US Airways, United, Continental, Eastern, etc.) did.

Of the remaining airlines, only United and Alaska still have language similar to Rule 240 in their contracts. United now calls it Rule 24, and Alaska calls it rule 240AS. The only problem these days is that with so many airlines operating virtual monopolies at some airports, and flights being so full, there is often no alternative seat available on other airlines.
